Facebook troll Bradley Paul Hampson released by Court of Appeal

THE "internet troll" who defaced the Facebook tribute pages of two slain Queensland schoolchildren has been released from prison after appealing his three-year jail term.
Lawyers for Bradley Paul Hampson, 29, were before the Court of Appeal in Brisbane in a bid to reduce his sentence on the grounds it was manifestly excessive.
The court, comprising Justices John Muir, Margaret White and Martin Daubney, this morning ordered Hampson be freed immediately and his 12-month minimum prison term be set aside.
They replaced it with a six-month sentence and took into account the 220 days already served behind bars.
They imposed an additional term that he be released on a two-year probation.
Hampson, of Tarragindi, on Brisbane's southside, pleaded guilty in March to two counts of using a carriage service, the internet, to cause offence and one each of distributing and possessing child exploitation material - meaning child pornography - between February 14 and June 4 last year.
Prosecutors said Hampson posted photographs of one victim with a penis drawn near their mouth and highly offensive messages, including "Woot I'm Dead", "Had It Coming" and others too offensive to publish.
The court was told the deaths of both children received extensive media coverage. However, under Queensland law, neither child could be identified.
Prosecutor Anthony Gett said Hampson used the pseudonym of "Dale Angerer" to engage in internet "trolling" - which means to post inflammatory, extraneous or off-topic messages in an "online community".
"This in my research is the first (criminal internet) trolling case . . . in Australia,'' Mr Gett said.
"These posts (by Hampson) were designed to offend all of the members (of the tribute sites).
"He was mocking the deaths of these children in a highly sexual manner.''
Barrister Carl Heaton, for Hampson, said his client's actions could be construed as those of "an appalling human being''.
However, he said Hampson, who was autistic, was retaliating against people who had been offensive toward him and a Facebook site designed to assist autistic people.
Judge Kerry O'Brien, in sentencing Hampson on March 25, said: "One can only judge your conduct as being depraved.''

THE first Australian convicted of "internet trolling'' by plastering child pornography on the Facebook tribute pages of two slain Queensland schoolchildren has been refused bail this morning pending his appeal against his three years jail term.
Brisbane Supreme Court judge Justice Jean Dalton, SC, this morning denied Bradley Paul Hampson, 29, bail ahead of his bid to have his sentence reduced by the Court of Appeal on June 3.
Barrister Carl Heaton, SC, for Hampson, argued his client will have served more than nine months of the minimum one year is required to spend in actual custody before the appeal hearing.
Justice Dalton refused bail, saying: "(Hampson) was in a difficult position in applying for bail after conviction ... (which) is only granted in exceptional circumstances.''
She noted Hampson, 29, also had a history for breaching bail by failing to appear in court, not reporting to police, failing to abide by residential conditions and accessing the social networking internet sex sites while in police custody.
On March 25 Hampson fronted the Brisbane District Court for posting offensive messages and photos on Facebook ``RIP tribute'' pages for a 12-year-old boy stabbed at a Brisbane school and a nine-year-old Bundaberg girl abducted and murdered in February last year.

Hampson, in documents filed into court last month said: "I Bradley Paul Hampson, of Brisbane Correctional Centre, in Wacol (west of Brisbane) ... apply to the Supreme Court for an order that I be admitted bail pending my appeal.''

The Brisbane District Court was told Bradley Paul Hampson, 29, posted offensive messages and photographs on Facebook "RIP tribute" pages for a 12-year-old boy stabbed at a Brisbane school and a nine-year-old Bundaberg girl abducted and murdered in February last year.
Hampson, of Tarragindi, on Brisbane's southside, on Friday pleaded guilty to two counts using a carriage service, the internet, to cause offence and one each of distributing and possessing child exploitation material -- meaning child pornography -- between February 14 and June 4 last year.

Judge Kerry O'Brien jailed Hamspon for three years, but ordered he be released after serving 12-months.
Judge O'Brien ordered Hampson be placed on a two-year probation order upon his release from jail.
