The Opposition yesterday accused the State Government of being in a "policy mess" over its election promise to revamp paedophile laws after it emerged that convicted child molester Gilbert John Hardwick was living near two schools and a childcare centre.
Under current child sex offender register laws, Hardwick must provide personal details to a database maintained by police.
But police are legally unable to share information of who is on the sex offender register, leaving schools unaware of any potential danger to students.
WA Secondary School Executives Association president Rob Nairn said there should be a screening process to make sure convicted paedophiles could not live close to a school.

Paedophile to face closer police scrutiny

Police will review the living arrangements of convicted child molester Gilbert John Hardwick amid concerns about paedophiles living near schools.
Hardwick's case has made headlines in recent weeks after it was revealed the 62-year-old was running an investigative website and living near two schools and a childcare centre.
He was jailed for 16 months in 2006 for molesting an eight-year-old boy and possessing child pornography, which he claimed he had gathered as part of his research.
Police Commissioner Karl O'Callaghan said yesterday he had asked specialist crime officers to review Hardwick's conditions.
"I think some of the issues that have been raised over the past few days make me concerned enough to want to review this person's case," he said.
"We're looking at his offending, where he's living, what risk that poses to the children going to the school and we're going to respond to that in some way." If police identify a problem they have to apply to the courts to have an offender's monitoring conditions varied.
Under sex offender register laws, Hardwick must provide personal details to a database maintained by police.
But police are legally unable to share information of who is on the sex offender register, leaving schools unaware of any potential risk to students.
Police Minister Rob Johnson said yesterday he was under the impression that as part of the orders and restrictions on sex offenders, they were not able to live near a school.
The Opposition has called for debate on the Barnett Government's promised re- vamp of paedophile laws to be brought forward.
Mr Johnson said he hoped to introduce legislation before the end of the year.
Mr O'Callaghan said the conditions imposed by the courts usually matched the type of offending. "In this case I'm not sure and I'm not convinced that the conditions are relevant and we will review those," he said.

Principals seek paedophile ban

Convicted paedophiles should be barred from living anywhere near schools, according to the head of WA's high school principals' group.
The Opposition yesterday accused the State Government of being in a "policy mess" over its election promise to revamp paedophile laws after it emerged that convicted child molester Gilbert John Hardwick was living near two schools and a childcare centre.
Under current child sex offender register laws, Hardwick must provide personal details to a database maintained by police.
But police are legally unable to share information of who is on the sex offender register, leaving schools unaware of any potential danger to students.
WA Secondary School Executives Association president Rob Nairn said there should be a screening process to make sure convicted paedophiles could not live close to a school.
"If you're a person who has had indecent dealings with children then you shouldn't be able to live near schools," he said.
Opposition Leader Eric Ripper said he did not believe Police Minister Rob Johnson's claim the laws would be introduced to Parliament this year, because he made the same promise 12 months ago.
"I think the Government is in a mess on this election promise, they can't work out what to do," Mr Ripper said.
Mr Johnson said the sex offender register was always a first-term commitment.
"WA Police and the Department of the Attorney-General, in consultation with other relevant agencies, have spent a considerable amount of time in drafting a model which strikes a balance between the right of parents to protect their children from harm and the right of an individual to privacy," he said.
WA Primary Principals Association president Stephen Breen said school leaders would like to be informed if a child molester was living nearby, so they could make contingency plans. WA Council of State School Organisations president Kylie Catto said parents would always want to be sure that every measure possible was taken to ensure students' safety, including efficient communication.
Association of Independent Schools of WA executive director Valerie Gould said because students travelled so widely they were not only vulnerable near schools, but also near parks, bus stops and shops.

Paedophile lives near schools

The State Opposition has called for debate to be brought forward on the Barnett Government's promised revamp of paedophile laws amid revelations a convicted child molester lives near two schools and a childcare centre.
Shadow police minister Margaret Quirk made the comments when asked whether schools near Gilbert John Hardwick's home should be notified of his living arrangements.
The Weekend West- has decided not to publish details of Hardwick's address.
Hardwick was convicted of molesting an eight-year-old boy and possessing child pornography and sentenced in 2006 to 16 months jail.
Under current child sex offender register laws, Hardwick must provide personal details to a secret database that is maintained by police.
But police are legally unable to share information of who is on the register.
"Existing laws are constrained," Ms Quirk said. "The Liberal government had an election commitment, we have not yet seen these laws."
Dubbed "Sofia's Law", the Barnett Government promised to make aspects of the register public in response to community outrage following the 2006 murder of schoolgirl Sofia Rodriguez-Urrutia Shu.
Yesterday, a spokeswoman for Police Minister Rob Johnson said he hoped to introduce legislation before the end of the year.
Yesterday, Hardwick, a former vice-president of the WA Council of Civil Liberties who promotes himself as an anthropologist and child sexuality consultant, said he did not pose any threat to children in the area.
"I've been here for two years, the only thing I do is stop and talk to the lollypop man on the way past because he is there," Hardwick said.
Hardwick claims the indecent dealing offence related to pulling up the boy's trousers.
He said images presented to the court in 2006, which Judge Allan Fenbury said were mostly images of naked children and included some depicting hardcore pornography, were taken out of context and were part of his research.
He said he was adhering to court orders to not access such material.
On one of his websites, Hardwick wrote he had nothing to hide and said he continued with his work.
He taunted police, saying: "You can raid my house again if you want, guys, but you won't find a scrap. It's in a safe place already, actually several safe places. Once bitten "
Yesterday, Hardwick said the message referred to his research. "I'm talking about my ongoing academic work, my research data, anything that comes up in the case of some future eventuality I have it protected so police cannot seize it and withhold it and destroy it," he said.

Margaret River man convicted on child sex charges

A District Court jury in Bunbury deliberated for three hours last night before convicting a 58-year-old Margaret River man of four offences relating to pornography and indecent dealings with a child.
Gilbert John Hardwick was convicted of one count of indecent dealing with a child under 13-years-old and three counts of possessing child pornography.
During the three-day trial the court heard Hardwick invited a young boy to his home to play video games and then indecently touched him.
He was also convicted of possessing photos of young boys, which he testified were part of his research.
Hardwick has been remanded in custody and is due to be sentenced on June 20.
