Dad Saves Son From Rape Attempt
Marcel Schauer, who has borderline intelligence, took a 13-year-old boy into the bushes at Andergrove to
have a smoke with him, forced himself on him and was about to rape him.
By coincidence, the boy’s father was driving in the area, saw his son’s bicycle, stopped and saved him.
Although Schauer pleaded guilty to attempted rape when he faced court on Friday, he will not be sentenced
until today because Judge Julie Dick, SC, wanted to do some extra research of legal authorities to make sure
she imposed an appropriate penalty on someone with Schauer’s unique circumstances. She also wants to impose
a suitable penalty that will protect our community.
Schauer appeared in court on Friday, on a dark day for Mackay, on which another man, William Lamb, 38, of
Grasstree Beach, admitted possessing child pornography that included 39 pictures and five videos of girls
aged five to 11 being molested.

On May 5 this year, a public holiday, he rode his bicycle with the 13-year-old boy to Andergrove, chained
the bikes together and went into the bushes for a cigarette.
“Schauer used physical force to subdue the boy,” Crown prosecutor Brendan Manttan said.
“He pulled down the boy’s pants and underpants and said: I am going to rape you, little bitch.
“The boy’s father came by, went to the bushland and saw his boy with his bottom exposed, on a
coffee table; Schauer was shirtless and was about to pull his own pants down.
“The father grabbed the boy and took him home.”
Barrister Paddy Cullinane, for Schauer, said Schauer had congenital cognitive problems.
Schauer was knocked off a bicycle by a car in an accident in 1983 and suffered an acquired brain injury.
He was of borderline intelligence and was assisted in the community by a carer from Mackay Advocacy Inc.
“He is under supervision in the community,” Mr Cullinane said.
“He is aware of the nature of the offending and the associated problems he has... and that he needs to address such issues.”
Schauer, who had family members and carers in court to support him, is expected to be sentenced today.
In a separate case,
William Lamb, 38, pleaded guilty to possessing child exploitation material at
Grasstree Beach on May 29.
Solicitor Paul Smith, for Lamb, tendered a psychologist’s report and three references and said
there was a low risk of reoffending. “He knew it was illegal and involved minors who couldn’t
give consent to sexual activity,” Mr Smith said.
Referees said Lamb felt misguided and knew having the images was inappropriate and he was truly
remorseful and was aware he had contributed to an ugly industry.
Judge Dick said possessing child pornography was not a victimless crime.
Lamb was jailed for 12 months, wholly suspended for two years.
