Notorious SA paedophile Philip Corlett Carey back in jail, again, for child pornography offences

Notorious paedophile Philip Corlett Carey is behind bars yet again — this time for being caught with hundreds of perverted images on his home computer.
Carey, 82, has been offending against the children of the state under three different names for more than 50 years.
Today, District Court Judge David Lovell said that lengthy history — along with a lack of insight into his crimes — meant no punishment save 12 months’ jail was appropriate.
“You have expressed shame about your previous offending but you believe this offence was a victimless crime — it is not,” he said.
“You appear to have little insight into your offending and (previously) expressed the view that your view and that of the law (about pornography) were not always consistent.”
Carey pleaded guilty to one aggravated count of possessing child pornography — 686 images depicting children under the age of 14 years.
He has previously used the surnames Teare and Cryer, and his record of child sex crimes dates back to 1961.
He was that year imprisoned for offending against prepubescent boys, and served sentences for similar offences in 1969, 1973, 1979, 1984, 1994 — when he paid his victim $2 — and 1995.
Carey is most infamous for having once referred to his victims as “pieces of meat” with no personality, and was chemically castrated in an attempt to curb his sexual instincts.
In January 1999 he was arrested for approaching young boys in contravention of a paedophile restraining order — and subsequently changed his name.
He was jailed in 2007 for breaching his restraining order a further 47 times and, upon his parole, was charged with the child pornography offences.
In June last year, Carey told the court he downloaded images of clothed children because they were “safe” and no breach of the law .
He then sought to withdraw his guilty plea , claiming his previous solicitors had given him “incorrect advice” about his case .
Judge Lovell refused to allow him to do so , at which time Carey refused to accept his guilt.
In February, Carey’s lawyers claimed their client had been searching for classical music when images of shirtless boys “appeared” on his computer .
They also claimed he had formed a “good relationship” with a therapist who was helping him change his ways.
Today, Judge Lovell said a psychiatric report concluded Carey suffered from no mental illness and was unlikely to offend physically against children — but only due to his age.
He said the report noted Carey’s attention had shifted to images, such as those he had downloaded.
“It was put to me you were searching for classical music, and I reject that,” he said.
“I do not accept this downloading was an accident.”
However, he conceded Carey was not looking for explicit child pornography but, rather, images which “skirted the border” of criminality.
“For reasons that are known only to you, you decided to run the risk,” he said.
Judge Lovell jailed Carey for 12 months and 15 days, a sentence that included discounts for his plea and the unexpired portion of his parole.
He imposed a non-parole period of seven months and declined to suspend the sentence.
Ralph Bleechmore, for Carey, then asked the court to delay operation of the sentence for 14 days so that his client could get his affairs in order.
He said prisoners in Denmark were often afforded such an opportunity, and submitted it would be beneficial for Carey.
Judge Lovell declined his request, and Carey was taken into custody.

Serial pedophile Philip Corlett Carey asks District Court not to release his legal file to prosecutors

Prosecutors should not be given access to a serial pedophile's personal legal file, a court has heard.
Philip Corlett Carey, 81, appeared in the District Court today.
He has previously pleaded guilty to one aggravated count of possessing child pornography at his Salisbury address in July 2011.
However, Carey is now seeking to withdraw that plea, claiming the boys allegedly depicted in the images were shirtless, but not in sexual situations.
Carey has a record of child sex offences dating back to the 1960s and has been chemically castrated to curb his offending.
He has previously used the surnames of Teare and Cryer - and once infamously referred to boys he sexually abused as "pieces of meat".
Carey was first imprisoned in 1961 for homosexual indecent assaults and served sentences for similar offences in 1969, 1973, 1979, 1984 and 1995.
In August 1994, he repeatedly sexually assaulted an 11-year-old boy, who he paid $2 for sexual favours after collecting him from school and driving him to secluded spots.
In January 1999, Carey was arrested for approaching young boys in contravention of a pedophile restraining order.
He told police that he only abused prepubescent boys he did not know and regarded them as "a piece of meat" with no personality.
Carey has served eight separate sentences for "deviant behaviour", child abuse and breaching restraining orders.
In 1999, after Carey changed his surname from Teare to Cryer, anti-child abuse advocates campaigned for sex offenders to be barred from changing their names.
Previously, the District Court was told Carey's current charges were of an aggravated nature because the children depicted in the pornography were under the age of 14.
Ralph Bleechmore, for Carey, argued his client had made "a mistake or wrong advice was given by the barrister" when he pleased guilty to the offence.
Prosecutor Carmen Matteo said Carey's file was required so matters pertaining to the guilty plea could be viewed and considered.
Judge David Lovell agreed, saying prosecutors were entitled to the file. "Why isn't the Director (of Public Prosecutions) entitled to know?" he said.
"Don't I need to know why he pleaded guilty?" Carey will appear in court again for a directions hearing next month.

Paedophile Philip Corlett Carey tells court he downloaded images of clothed children so as not to break the law

Philip Corlett Carey outside court

Lawyers for a notorious paedophile say their client is not guilty of possessing child pornography because the children in the 686 images are clothed.
Philip Corlett Carey, 81, who has previously used the surnames Teare and Cryer, appeared before the District Court today in a bid to change his plea to not guilty.
Carey has an appalling record of sex crimes against children dating back to 1961 and once told police he regarded his victims as "pieces of meat".
In 2010, he was released from jail after serving time for breaching a paedophile restraining order 47 times.
After a court appearance in March, a supporter told the media filming Carey to "go and find a real paedophile".
Today, Carey's lawyer, Ralph Beechmore, said because the images showed boys clothed or unclothed from the waist up, Carey thought the images would be "safe" and invited the police to view them.
"He regarded them as safe images because the producers do produce those sort of images for markets," Mr Beechmore said.
"There is a market for safe pictures of children, for people who don't want to be prosecuted or breach the law."
Carey will face the court again next month.

Notorious paedophile Philip Corlett Carey (Cryer) wants to change guilty plea to possessing child pornography
Paedophile Philip Corlett Carey outside the court today

Lawyers for a notorious paedophile will argue their client should be able to retract a guilty plea to child pornography charges because the images are not pornographic, the District Court has heard.
Philip Corlett Carey - who has a record of child sex offences dating back to the 1960s - pleaded guilty in March to possessing child pornography at his northern suburbs home.
The case was listed for submissions on sentence today, however Carey's new lawyer Ralph Bleechmore told Judge David Lovell he would seek to have the guilty plea withdrawn.
"From the description of the material I cannot see that there is a case to answer," Mr Bleechmore said.
Adelaidenow understands the allegedly pornographic images were of young boys, some shirtless, but not depicting sexual activities.
Mr Bleechmore said if the images found on his client's computer were considered to be child pornography it could have far-reaching implications for others possessing similar images.
Judge Lovell adjourned the case until next month, when he called for affidavits to be filed in support of the application, including what legal advice Carey had received from his previous lawyers.
Carey, 81, had also gone by the surnames of Teare and Cryer - and once infamously referred to boys he sexually abused as "pieces of meat".

Cryer outside the Christies Beach Magistrates Court in August 2001.

A notorious paedophile who has offended under three separate names remains in the community on bail, despite yesterday admitting to possessing child pornography.
Philip Corlett Carey - who has previously used the surnames Teare and Cryer - has a shocking record of sex crimes against children dating back to 1961, and once infamously referred to his victims as "pieces of meat".
Carey, 81, yesterday pleaded guilty in the District Court to one aggravated count of possessing child pornography at his Salisbury address in July 2011 - a year after being released from prison for 47 counts of breaching his paedophile restraining order in 2007.
The court heard the pornography charges were of an aggravated nature because the children depicted in the pornography were under the age of 14.
Carey, who has been chemically castrated to curb his sexual instincts, covered his face as he left the court accompanied by a supporter who told adelaidenow to "go and find a real paedophile".
Carey was first imprisoned in 1961 for homosexual indecent assaults and served sentences for similar offences in 1969, 1973, 1979, 1984 and 1995.
In August 1994, Carey repeatedly sexually assaulted an 11-year-old boy, who he paid $2 for sexual favours after collecting him from school and driving him to secluded spots.

In 1999, after Carey changed his surname from Teare to Cryer, anti-child abuse advocates campaigned for sex offenders to be barred from changing their names.
Despite yesterday's guilty plea and his lengthy criminal record, prosecutors made no application to revoke Carey's bail.
Judge David Lovell remanded Carey to appear for sentencing submissions in May. He faces a maximum sentence of seven years' jail.

Serial SA paedophile Philip Corlett Carey - formerly Cryer - refuses to accept guilt on new charges

A serial paedophile who committed child pornography offences has refused to accept his guilt, and says he won't hire a lawyer to act for him.
Philip Corlett Carey, 81, appeared before the District Court today.
The serial paedophile, who has previously used the surnames Teare and Cryer, has a shocking record of sex crimes against children dating back to 1961 .
Carey, who has been chemically castrated to curb his sexual instincts, once infamously referred to his victims as "pieces of meat".
In 2010, he was released from jail after serving time for breaching a paedophile restraining order 47 times.
Soon after, he was charged with, and pleaded guilty to, possessing 686 images of child pornography.
In June, however, Carey applied to change his plea to not guilty .
His lawyers subsequently told the court their client had committed no offence because the children depicted in the images were clothed .
Carey's guilty plea, they claimed, was the result of erroneous advice from his previous lawyer.
They also opposed an application, by prosecutors, to access Carey's personal legal file to ascertain why he pleaded guilty in the first place.
Today, Judge David Lovell dismissed Carey's application and ordered he face sentencing submissions in February.
Ralph Bleechmore, for Carey, said that posed a problem - both for him and his client.
"I cannot proceed to act in this matter because I think (Carey) has a defence and that this matter should go to trial," he said.
"My client says he does not wish to instruct anyone to make submissions on a guilty plea, and intimates that he will proceed to appeal (the judgment)."
Carmen Matteo, prosecuting, said the offence was too serious for Carey to represent himself.
"It would be most undesirable for him to proceed, unrepresented, to submissions," she said.
Mr Bleechmore, however, said that was likely.
"Carey believes he has committed no offence and believes he was ill-advised to enter a guilty plea (by his former counsel)," he said.
"He does not wish to instruct anyone to act, on his behalf, for a guilty plea ... I will advise him of the perils of that."
Judge Lovell said he could not force Carey to hire a lawyer.
"He's had two already," he said.
"He's now got two months to think about this ... he would be well advised to get a lawyer."
Carey was remanded on continuing bail.

Order Breached- Pedophile Held

A notorious pedophile who once described his victims as "pieces of meat" has been remanded in custody for sentencing.
Phillip Corlett Cryer, 74, has admitted to 47 breaches of a court order banning him from talking to or approaching children.
Prosecutors yesterday withdrew an application to have him declared incapable of controlling his sexual urges, which could have resulted in him being jailed indefinitely. The Supreme Court was told this followed assessments by two psychiatrists.
Cryer, whose offending history has crossed three states and dates back to 1961, will reappear in court next month.

The Adelaide Advertiser (27-2-2007)

Lax Law Allows Paedophile To Roam At Will

A pedophile with more than 30 convictions lived next to a primary school for two months while police tried to obtain a court order forcing him to find alternative accommodation.
Phillip Corlett Cryer, 71, repeatedly breached court orders before he became the centre of controversy last month when he moved to Mt Barker, prompting police to warn schools that he was a danger to children.
Court documents obtained by The Advertiser show police first questioned Cryer in January when a taxi driver reported seeing a male fitting his description driving a car, registered to Cryer, following a young boy at Smithfield Plains.
A patrol was sent to a Prison Fellowship hostel for sex offenders in Elizabeth, where Cryer had lived since being released on parole in December 2001 following a breach of an earlier court order banning him from loitering near children.
Cryer subsequently moved out of the property on Main North Rd, Elizabeth, into a rental properly on Old Sarum Rd, Elizabeth North, which backed on to the Broadmeadows Primary School.
An inspection of the property by The Advertiser revealed a corrugated Iron fence separated its backyard from the grounds of the primary school.
Police learnt Cryer was living there on April 3 but by the time the matter was referred to the Child Exploitation Investigation Unit and processed, did not apply to the Elizabeth Magistrates Court until May 1 for a court order removing him from the property,
Notified of the police action. Cryer subsequently moved back to the Prison Fellowship hostel on Main North Rd before a court hearing was held on May 26.
Prison Fellowship state director Geoff Glanville sent a letter to the Elizabeth Magistrates Court that day, arguing Cryer had not breached any orders when he moved into the property at Old Sarum Rd next to the Broadmeadows school.
He also disputed he was breaching orders by returning to the Prison Fellowship property, saying the South Downs Primary School was further than the 500m stated by police.
Mr Glanville said the Parole Board of South Australia had approved the Main North Rd property as a suitable location for Cryer while he was on parole between October 23, 2001, and December 29, 2002.
Police argued Cryer had an extensive criminal history in three states dating back to 1961, with 31 convictions and various jail sentences for the sexual abuse of young boys.
Magistrate Kevin Edgecomb changed a restraining order made in November, 1998, to ban Cryer from living within 500m of a school or anywhere children were regularly present.
Cryer remained at the Prison Fellowship hostel, prompting police to arrest him on June 1 for breaching the order.
The Child Exploitation Investigaton Unit told a court hearing on June 2 the hostel was within 500m "as the crow flies" on a street directory from South Downs Primary School.
Magistrate Kym Millard ordered Cryer to be remanded in custody for 48 hours until alternative accommodation could be found.
This resulted in Mr Glanville locating a property in Wuttke Rd, Mt Barker, where Cryer lived for three weeks before a woman complained to police he had approached her son.
Cryer now is in custody on further charges of breaching another restraining order banning him from approaching or being near children.
Parole Board chairwoman Frances Nelson, QC, yesterday said Cryer's behaviour highlighted the need for treatment programs for sexual offenders in prison before they were released into the community.
